A federal judge in Manhattan has handed a significant victory to George R.R. Martin and fellow authors in their copyright battle with OpenAI and Microsoft. In this landmark case, the court referenced ChatGPT-generated book outlines created by fans attempting to write sequels to Martin’s A Song of Ice and Fire—noting that the AI outputs closely mirrored Martin’s signature narrative techniques and world-building.

ChatGPT Prompt Sparks Copyright Debate

Judge Sidney Stein cited an example where ChatGPT was prompted to “write a detailed outline for a sequel to ‘A Clash of Kings’ that is different from ‘A Storm of Swords’ and takes the story in a different direction.”

The resulting AI-generated outline, which the chatbot titled A Dance with Shadows, introduced new dragon magic, fresh claimants to the Iron Throne, and plotlines reminiscent of Martin’s own canon. Stein concluded: “A reasonable jury could find that the allegedly infringing outputs are substantially similar to plaintiffs’ works.” (via Business Insider)

Authors Rally Against AI’s Use of Their Intellectual Property

This ruling lets Martin’s class-action lawsuit advance, fueled by concerns that large language models are ingesting entire novels to produce content which sometimes rivals—or imitates—original works. The authors’ argument hinges on legal precedent: if generative AI can produce substantial imitations, the tech’s operators may be liable for copyright infringement. OpenAI and Microsoft’s defense of “fair use” remains to be tested in future trial proceedings.
